How to Record a Will

Recording a will is an important step after an individual passes away to ensure their final wishes are officially documented and preserved. The Madison County Clerk’s Office accepts original wills that have gone through probate in District Court.

Clerk’s Note Regarding Original Wills

​In accordance with KRS 394.300, every will or authenticated copy admitted to record by any court must be recorded by the County Clerk and retained securely. The original will remains in the Clerk’s custody and may only be removed by court order (subpoena duces tecum).

The public may view wills only through the recorded version—via the will book, microfilm, or digital images—consistent with all other recorded documents.

Step 1: Probate Requirement

Before a will can be recorded at the Clerk’s Office, it must go through probate at the District Court. Probate validates the will and provides the necessary court order for recording.

The court will issue a court order confirming probate, which must accompany the original will when submitted to the Clerk’s Office.

Step 2: Recording a Will
at the Clerk's Office

To record a will: Bring the original will along with the court order from probate.

Submit them to the Madison County Clerk’s Office.

Note: The Clerk's Office will retain the original will permanently.

Fees & Copies

Recording a will: $47.00 for the first five (5) pages; $3.00 for each additional page

​

Standard copies of a recorded will: $0.25 per page

​

Certified copies: $5.00 for the first three (3) pages; $0.50 for each additional page

​

Copies and certified copies are useful for estate administration or legal matters.
